AIRLINE LITIGATION & EU 261 DEFENCE

Czech legal representation for airlines facing passenger claims, commercial disputes and litigation before Czech courts.

I advise and represent air carriers in disputes arising from airline operations, with a particular focus on passenger claims under Regulation (EC) No 261/2004, cross-border litigation and recurring claims brought before Czech courts.

01 - Czech Litigation Counsel for Airlines

I represent domestic and foreign airlines before Czech courts, from pre-litigation assessment and written submissions to hearings, settlement negotiations and available procedural remedies.

I work directly with your in-house legal team, claims department or international counsel. For airlines without an in-house legal team, or those that prefer to outsource their legal function, I can assemble and lead a dedicated external legal team tailored to the airline's needs.

Whether supporting your existing lawyers or coordinating your outsourced legal team, I remain your primary point of contact. The scope of services, reporting arrangements and immediate priorities, including court deadlines, are agreed at the outset.

02 - EU261 Defence: Evidence & Extraordinary Circumstances

I advise on claims under Regulation (EC) No 261/2004 involving delays, cancellations and denied boarding. Compensation, reimbursement and care claims are assessed separately, according to their distinct legal requirements.

Operational Evidence

I review flight and rotation records, weather data, air traffic restrictions, technical reports and passenger communications to establish what happened and identify evidentiary gaps.

Extraordinary Circumstances

I assess whether the disruption supports an extraordinary-circumstances defence, how it affected the flight and what evidence is needed to substantiate the airline's position.

Reasonable Measures

I examine the measures taken and alternatives reasonably available, including rerouting options, to assess whether the compensation defence can be sustained.

03 - Jurisdiction & Assigned Passenger Claims

Jurisdiction & Procedural Objections

I examine international and territorial jurisdiction, service of proceedings and the deadlines for raising relevant objections. Cross-border bookings and connecting flights are assessed against the circumstances of the individual case.

 Claims Agencies & Legal Standing

Where a claim is pursued by an assignee or intermediary, I review the claimant's legal standing, assignment documents and authority to act. Potential objections are evaluated on their merits, not raised automatically.

04 - Recurring EU261 Claims & Settlement Strategy

I help airlines manage recurring passenger claims through a consistent approach to evidence, legal arguments and settlement decisions. Related cases are reviewed together, while differences that may affect individual outcomes are preserved.

Recommendations take account of the merits, procedural costs and the implications for other pending claims. The aim is to pay or settle justified claims efficiently and defend cases where the evidence and legal position support doing so.

05 - Commercial Airline Disputes

I represent airlines in contractual and damages disputes involving suppliers, technology providers, agents and other operational partners. I assess contractual remedies, termination risks, recoverable loss and the available evidence.

Where the relationship remains important to ongoing operations, I also consider negotiated solutions before recommending litigation.

06 - Airline Experience & Direct Representation

My airline-sector experience includes work in data protection and cybersecurity governance at Smartwings and Czech Airlines. This provides practical insight into internal decision-making, access to operational evidence and the wider business implications of a dispute.

You work directly with me, Mgr. František Kubečka, LL.M., a Czech barrister. I remain personally involved in the legal analysis and agreed litigation strategy.
